Please read these Terms and Conditions carefully before using our website or engaging our services. By accessing https://akal.blog or entering into a service arrangement with Akal, you confirm that you have read, understood, and agree to be bound by these terms. 1. Definitions
"Akal" / "we" / "us" / "our" — refers to Akal, a business advisory practice registered and operating from No. 38, Jalan Pasar, 14000 Bukit Mertajam, Pulau Pinang, Malaysia.
"Website" — the website available at https://akal.blog and all its pages.
"Services" — the AI integration advisory services offered by Akal, namely the Discovery Conversation, Process Companion Package, and Steady Guidance Retainer.
"Client" / "you" — any individual or business entity that engages Akal for services or uses the Website.
"Agreement" — these Terms and Conditions together with any written engagement letter or service confirmation.
"Content" — all text, images, documents, materials, and information on the Website.
2. Acceptance of Terms
By using this Website or engaging our Services, you represent that:
- You are at least 18 years of age and have the legal capacity to enter into binding agreements.
- If entering on behalf of a business, you have the authority to bind that business to these terms.
- All information you provide to us is accurate to the best of your knowledge.
3. Service Description
Akal provides advisory services to small and owner-operated businesses in Malaysia, focusing on the thoughtful adoption of simple AI-related tools. Our three service offerings are:
Discovery Conversation — RM 680
A single advisory session to explore your daily workflows and identify areas where simple tools may help. Includes a written plain-language summary. No ongoing obligation.
Process Companion Package — RM 1,360
A three-to-four-week hands-on engagement to configure one selected tool with your team, including reference materials and follow-up check-ins.
Steady Guidance Retainer — RM 2,300 / month
An ongoing advisory arrangement with regular review calls and considered recommendations. Scope is agreed in advance. You may pause or reduce the arrangement at any time with reasonable notice.
Service availability is subject to Akal's capacity. We reserve the right to decline or defer an engagement if we believe it is not a suitable fit for the client's needs at the time.
4. Your Responsibilities
When using our Website or engaging our Services, you agree to:
- Provide accurate and complete information when requested.
- Attend or make available staff members for scheduled sessions as agreed.
- Not use our Website for any unlawful purpose or in a way that harms others.
- Not attempt to gain unauthorised access to our systems or introduce harmful code.
- Respect the intellectual property of Akal and third parties.
- Give us timely feedback and reasonable access to relevant business processes during engagements.
5. Payment Terms
All fees are quoted and payable in Malaysian Ringgit (RM).
- Discovery Conversation: Full payment is due before the session date.
- Process Companion Package: 50% deposit required before work commences; balance due upon completion.
- Steady Guidance Retainer: Monthly fee invoiced at the start of each calendar month.
Invoices are payable within 14 days of issuance. We accept bank transfer and other methods agreed in writing. Where payment is overdue, we may pause work until settlement is received.
Refund policy: If you cancel a Discovery Conversation with at least 48 hours' notice, we will offer a full refund or reschedule at no charge. Cancellations with less notice may incur a processing fee. For package and retainer engagements, refund arrangements will be discussed and agreed case by case.
6. Intellectual Property
All content on the Website — including text, design, structure, and graphics — is the property of Akal and protected under applicable Malaysian intellectual property law.
You are granted a limited, non-exclusive licence to view and use the Website for your own personal or business evaluation purposes. You may not reproduce, distribute, or commercially exploit any part of the Website without our prior written consent.
Written deliverables (such as summaries or reference notes) produced during a service engagement are provided to you for your own business use. Akal retains the right to use anonymised, non-attributable insights from engagements to improve its services.
7. Confidentiality
We understand that in the course of our work you may share information about your business operations that is sensitive. We treat all such information as confidential and will not disclose it to any third party without your consent, except where required by law.
We ask that you similarly treat our working methods, tools, and internal processes as confidential.
8. Disclaimers
Our Website and Services are provided in good faith, but we make no representation that:
- The Website will be uninterrupted, error-free, or free from harmful elements.
- Our advisory guidance will achieve any specific outcome for your business.
- Any tool or approach we recommend will be suitable for every context.
Our role is to offer informed, considered guidance. The decisions you make about adopting or not adopting any tool remain yours. We are not accountable for outcomes arising from decisions made independently by you or your team.
The information on this Website does not constitute legal, financial, or accounting advice.
9. Limitation of Liability
To the maximum extent permitted by Malaysian law, Akal's total liability to you in connection with any claim arising out of or related to our Services or Website shall not exceed the fees you have paid to us in the three months preceding the event giving rise to the claim.
In no event shall Akal be liable for indirect, incidental, special, or consequential losses, including loss of revenue, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such losses.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
10. Indemnification
You agree to indemnify and hold harmless Akal and its consultants from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Website, or your violation of any applicable law or third-party rights.
11. Termination
By you: You may end a service engagement by giving us written notice. For the Steady Guidance Retainer, reasonable notice means at least 14 calendar days before the next billing date. For project-based services, early termination fees may apply to cover work already performed.
By Akal: We may end an engagement or restrict access to our Website where you have materially breached these Terms, where payment is significantly overdue, or where continuing the relationship is no longer feasible for either party.
Clauses relating to intellectual property, confidentiality, limitation of liability, and dispute resolution survive termination.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising shall first be attempted through informal discussion. We are a small practice and prefer to resolve concerns in an open, direct conversation.
If informal resolution is not reached within 30 days, either party may refer the matter to mediation through the Malaysian Mediation Centre before pursuing formal legal proceedings.
Any unresolved dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia.
13. General Provisions
Entire agreement: These Terms, together with any signed engagement letter, constitute the full agreement between the parties on the subject matter herein.
Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign ours in connection with a business transfer.
Force majeure: Neither party will be in breach if unable to perform due to events outside their reasonable control, including natural disasters, government action, or infrastructure failures.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top. Continued use of the Website or Services after that date constitutes acceptance of the revised terms. For material changes affecting existing service engagements, we will notify clients directly.
